LTB Forms T1: Tenant Application for a Rent Reduction

The T1 Tenant Application for a Rent Reduction is a form submitted to the Landlord and Tenant Board (LTB) that allows tenants to request a refund for unfairly charged amounts by the landlord or to receive money that the landlord is obligated to pay. This application applies to eight situations where tenant rights can be protected, such as illegal rent, illegal fees, or unreturned deposits.

If the landlord has charged unfair amounts or failed to return a legitimate amount, the tenant can submit a T1 application to the LTB to request a refund.

Situations for requesting a refund:

  • Illegal rent refund: When rent paid exceeds the legal limit.
  • Refund of illegal fees: When the tenant has paid fees that the landlord or agent is not authorized to charge.
  • Request for refund of last month's rent deposit: When the landlord does not return the deposit as required.
  • Refund after refusal of entry: When the tenant is denied entry after signing the lease, and the deposit is not returned.
  • Failure to pay interest on the deposit: If interest on the last month's rent deposit has not been paid.
  • Eviction compensation: When compensation is not provided after eviction for reasons such as demolition, repairs, or landlord’s use.
  • Return of proceeds from the sale of personal property: If the tenant’s property was sold but the proceeds were not returned (available to former tenants only).
  • Failure to notify of rent increase ban: When the tenant has not been notified that a rent increase ban applies.

Both current and former tenants can apply, and the LTB can order the return of amounts if it confirms the landlord's violations of regulations concerning tenant rights and illegal charges related to rent.

Potential tenants can also apply if they paid illegal fees or a deposit but were denied entry.
