T1: Tenant Application for a Refund
The T1 Tenant Application for a Refund is a document submitted to the Landlord and Tenant Board (LTB) to request a refund of any unjustly charged amounts by the landlord or to receive a payment that the landlord should have made. This application can be used in 8 specific cases to protect tenants' rights.
If the landlord has charged an unfair amount or has failed to return a legitimate amount, tenants can file the T1 application with the LTB to request a refund.
When Can You Use the T1 Application?
The T1 application can be used in the following situations:
- Refund for Illegal Rent: If you paid rent above the legal limit, you can apply for a refund.
- Refund for Illegal Charges: If you paid any fees not allowed by the landlord or their agent, you can request a refund.
- Refund of Last Month's Rent Deposit: If the landlord failed to return the last month’s rent deposit for the proper purpose, you can request its return.
- Refund of Deposit After Refusal of Tenancy: If your tenancy was refused after you signed the lease, and the deposit was not returned, you can request a refund.
- Failure to Pay Interest on Last Month’s Rent Deposit: If the interest on your last month's rent deposit was not paid, you can apply for the interest amount.
- Compensation for Eviction: If you were evicted due to reasons like property demolition, repairs, or the landlord’s own use and were not compensated, you can request compensation.
- Return of Sale Proceeds from Personal Property: If the landlord sold your personal property and did not return the proceeds (this only applies to former tenants).
- Failure to Notify Rent Increase Ban: If you were not notified that a rent increase ban applied to your unit, you can apply for a refund.
Who Can Apply?
Both current and former tenants can apply. If there has been an unlawful charge or failure to return a deposit, the LTB can order the landlord to refund the amount once they confirm the violation of regulations.
Even potential tenants who paid unlawful fees or a deposit but had their tenancy refused can apply.
